Please read these Terms and Conditions («Terms», «Terms and Conditions») carefully before using Bookster («the App») operated by Bookify, Inc. («us», «we», or «our»).
Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use the App.
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
All content, features, and functionality (including but not limited to all information, text, graphics, images, designs, and the selection and arrangement thereof) of the App are the exclusive property of Bookify, Inc. and are protected by copyright, trademark, and other intellectual property laws.
To access some features of the App, you may be required to register for an account. When you register, you agree to provide accurate and complete information and to update this information as necessary to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
By using the App, you agree not to:
Use the App for any illegal, unauthorized, or unethical purpose;
Attempt to gain unauthorized access to the App or its systems;
Upload, transmit or distribute any computer viruses, worms, or any software intended to damage or alter a computer system;
Interfere with or disrupt the App or servers or networks connected to the App;
Harass, threaten, or harm any other user or any third party in any way.
We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these Terms.
The App may offer subscription plans with different features and benefits. When you subscribe to a plan, you agree to pay the fees associated with that plan. Subscription fees will be charged on a recurring basis until you cancel your subscription.
We reserve the right to change the pricing for our subscription plans at any time. We will provide you with prior notice of any such changes, and you may cancel your subscription if you do not agree with the new pricing.
You may cancel your subscription at any time. Upon cancellation, your subscription will terminate at the end of the current billing period. No refunds will be provided for any unused portion of your subscription period.
We reserve the right to modify, suspend or discontinue, temporarily or permanently, the App or any service provided by the App, with or without notice, and without liability to you.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the App will cease immediately.
The App is provided on an «as is» and «as available» basis. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Bookify, Inc. or its affiliates, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential or punitive damages, including, without limitation, loss of profits, data, use, or goodwill, arising out of or in connection with your access to, use of, or inability to use the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
You agree to defend, indemnify, and hold harmless Bookify, Inc., its affiliates, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from:
Your use of and access to the App;
Your violation of any term of these Terms;
Your violation of any third-party rights, including, without limitation, any copyright, trademark, property, or privacy right; or
Any claim that your use of the App caused damage to a third party.
This indemnification obligation will survive the termination of these Terms and your use of the App.
These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Delaware to resolve any dispute arising out of these Terms or your use of the App.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you must stop using the App.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
These Terms constitute the entire agreement between you and Bookify, Inc. regarding your use of the App, superseding any prior agreements between you and Bookify, Inc. concerning your use of the App.
